8012556: Implement lambda methods on interfaces as static
8006140: Javac NPE compiling Lambda expression on initialization expression of static field in interface
Summary: Lambdas occurring in static contexts or those not needing instance information should be generated into static methods. This has long been the case for classes. However, as a work-around to the lack of support for statics on interfaces, interface lambda methods have been generated into default methods. For lambdas in interface static contexts (fields and static methods) this causes an NPE in javac because there is no 'this'. MethodHandles now support static methods on interfaces. This changeset allows lambda methods to be generated as static interface methods. An existing bug in Hotspot (8013875) is exposed in a test when the "-esa" flag is used. This test and another test that already exposed this bug have been marked with @ignore.

jeff@1016 198 This formulation of W3C's notice and license became active on December 31
jeff@1016 199 2002. This version removes the copyright ownership notice such that this
jeff@1016 200 license can be used with materials other than those owned by the W3C, reflects
jeff@1016 201 that ERCIM is now a host of the W3C, includes references to this specific
jeff@1016 202 dated version of the license, and removes the ambiguous grant of "use".
jeff@1016 203 Otherwise, this version is the same as the previous version and is written so
jeff@1016 204 as to preserve the Free Software Foundation's assessment of GPL compatibility

jeff@1016 237 of this license document, but changing it is not allowed.
jeff@1016 238
jeff@1016 239 [This is the first released version of the Lesser GPL. It also counts
jeff@1016 240 as the successor of the GNU Library Public License, version 2, hence
jeff@1016 241 the version number 2.1.]
jeff@1016 242
jeff@1016 243 Preamble
jeff@1016 244
jeff@1016 245 The licenses for most software are designed to take away your
jeff@1016 246 freedom to share and change it. By contrast, the GNU General Public
jeff@1016 247 Licenses are intended to guarantee your freedom to share and change
jeff@1016 248 free software--to make sure the software is free for all its users.
jeff@1016 249
jeff@1016 250 This license, the Lesser General Public License, applies to some
jeff@1016 251 specially designated software packages--typically libraries--of the
jeff@1016 252 Free Software Foundation and other authors who decide to use it. You
jeff@1016 253 can use it too, but we suggest you first think carefully about whether
jeff@1016 254 this license or the ordinary General Public License is the better
jeff@1016 255 strategy to use in any particular case, based on the explanations below.
jeff@1016 256
jeff@1016 257 When we speak of free software, we are referring to freedom of use,
jeff@1016 258 not price. Our General Public Licenses are designed to make sure that
jeff@1016 259 you have the freedom to distribute copies of free software (and charge
jeff@1016 260 for this service if you wish); that you receive source code or can get
jeff@1016 261 it if you want it; that you can change the software and use pieces of
jeff@1016 262 it in new free programs; and that you are informed that you can do
jeff@1016 263 these things.
jeff@1016 264
jeff@1016 265 To protect your rights, we need to make restrictions that forbid
jeff@1016 266 distributors to deny you these rights or to ask you to surrender these
jeff@1016 267 rights. These restrictions translate to certain responsibilities for
jeff@1016 268 you if you distribute copies of the library or if you modify it.
jeff@1016 269
jeff@1016 270 For example, if you distribute copies of the library, whether gratis
jeff@1016 271 or for a fee, you must give the recipients all the rights that we gave
jeff@1016 272 you. You must make sure that they, too, receive or can get the source
jeff@1016 273 code. If you link other code with the library, you must provide
jeff@1016 274 complete object files to the recipients, so that they can relink them
jeff@1016 275 with the library after making changes to the library and recompiling
jeff@1016 276 it. And you must show them these terms so they know their rights.
jeff@1016 277
jeff@1016 278 We protect your rights with a two-step method: (1) we copyright the
jeff@1016 279 library, and (2) we offer you this license, which gives you legal
jeff@1016 280 permission to copy, distribute and/or modify the library.
jeff@1016 281
jeff@1016 282 To protect each distributor, we want to make it very clear that
jeff@1016 283 there is no warranty for the free library. Also, if the library is
jeff@1016 284 modified by someone else and passed on, the recipients should know
jeff@1016 285 that what they have is not the original version, so that the original
jeff@1016 286 author's reputation will not be affected by problems that might be
jeff@1016 287 introduced by others.
jeff@1016 288
jeff@1016 289 Finally, software patents pose a constant threat to the existence of
jeff@1016 290 any free program. We wish to make sure that a company cannot
jeff@1016 291 effectively restrict the users of a free program by obtaining a
jeff@1016 292 restrictive license from a patent holder. Therefore, we insist that
jeff@1016 293 any patent license obtained for a version of the library must be
jeff@1016 294 consistent with the full freedom of use specified in this license.
jeff@1016 295
jeff@1016 296 Most GNU software, including some libraries, is covered by the
jeff@1016 297 ordinary GNU General Public License. This license, the GNU Lesser
jeff@1016 298 General Public License, applies to certain designated libraries, and
jeff@1016 299 is quite different from the ordinary General Public License. We use
jeff@1016 300 this license for certain libraries in order to permit linking those
jeff@1016 301 libraries into non-free programs.
jeff@1016 302
jeff@1016 303 When a program is linked with a library, whether statically or using
jeff@1016 304 a shared library, the combination of the two is legally speaking a
jeff@1016 305 combined work, a derivative of the original library. The ordinary
jeff@1016 306 General Public License therefore permits such linking only if the
jeff@1016 307 entire combination fits its criteria of freedom. The Lesser General
jeff@1016 308 Public License permits more lax criteria for linking other code with
jeff@1016 309 the library.
jeff@1016 310
jeff@1016 311 We call this license the "Lesser" General Public License because it
jeff@1016 312 does Less to protect the user's freedom than the ordinary General
jeff@1016 313 Public License. It also provides other free software developers Less
jeff@1016 314 of an advantage over competing non-free programs. These disadvantages
jeff@1016 315 are the reason we use the ordinary General Public License for many
jeff@1016 316 libraries. However, the Lesser license provides advantages in certain
jeff@1016 317 special circumstances.
jeff@1016 318
jeff@1016 319 For example, on rare occasions, there may be a special need to
jeff@1016 320 encourage the widest possible use of a certain library, so that it becomes
jeff@1016 321 a de-facto standard. To achieve this, non-free programs must be
jeff@1016 322 allowed to use the library. A more frequent case is that a free
jeff@1016 323 library does the same job as widely used non-free libraries. In this
jeff@1016 324 case, there is little to gain by limiting the free library to free
jeff@1016 325 software only, so we use the Lesser General Public License.
jeff@1016 326
jeff@1016 327 In other cases, permission to use a particular library in non-free
jeff@1016 328 programs enables a greater number of people to use a large body of
jeff@1016 329 free software. For example, permission to use the GNU C Library in
jeff@1016 330 non-free programs enables many more people to use the whole GNU
jeff@1016 331 operating system, as well as its variant, the GNU/Linux operating
jeff@1016 332 system.
jeff@1016 333
jeff@1016 334 Although the Lesser General Public License is Less protective of the
jeff@1016 335 users' freedom, it does ensure that the user of a program that is
jeff@1016 336 linked with the Library has the freedom and the wherewithal to run
jeff@1016 337 that program using a modified version of the Library.
jeff@1016 338
jeff@1016 339 The precise terms and conditions for copying, distribution and
jeff@1016 340 modification follow. Pay close attention to the difference between a
jeff@1016 341 "work based on the library" and a "work that uses the library". The
jeff@1016 342 former contains code derived from the library, whereas the latter must
jeff@1016 343 be combined with the library in order to run.
jeff@1016 344
jeff@1016 345 GNU LESSER GENERAL PUBLIC LICENSE
jeff@1016 346 TERMS AND CONDITIONS FOR COPYING, DISTRIBUTION AND MODIFICATION
jeff@1016 347
jeff@1016 348 0. This License Agreement applies to any software library or other
jeff@1016 349 program which contains a notice placed by the copyright holder or
jeff@1016 350 other authorized party saying it may be distributed under the terms of
jeff@1016 351 this Lesser General Public License (also called "this License").
jeff@1016 352 Each licensee is addressed as "you".
jeff@1016 353
jeff@1016 354 A "library" means a collection of software functions and/or data
jeff@1016 355 prepared so as to be conveniently linked with application programs
jeff@1016 356 (which use some of those functions and data) to form executables.
jeff@1016 357
jeff@1016 358 The "Library", below, refers to any such software library or work
jeff@1016 359 which has been distributed under these terms. A "work based on the
jeff@1016 360 Library" means either the Library or any derivative work under
jeff@1016 361 copyright law: that is to say, a work containing the Library or a
jeff@1016 362 portion of it, either verbatim or with modifications and/or translated
jeff@1016 363 straightforwardly into another language. (Hereinafter, translation is
jeff@1016 364 included without limitation in the term "modification".)
jeff@1016 365
jeff@1016 366 "Source code" for a work means the preferred form of the work for
jeff@1016 367 making modifications to it. For a library, complete source code means
jeff@1016 368 all the source code for all modules it contains, plus any associated
jeff@1016 369 interface definition files, plus the scripts used to control compilation
jeff@1016 370 and installation of the library.
jeff@1016 371
jeff@1016 372 Activities other than copying, distribution and modification are not
jeff@1016 373 covered by this License; they are outside its scope. The act of
jeff@1016 374 running a program using the Library is not restricted, and output from
jeff@1016 375 such a program is covered only if its contents constitute a work based
jeff@1016 376 on the Library (independent of the use of the Library in a tool for
jeff@1016 377 writing it). Whether that is true depends on what the Library does
jeff@1016 378 and what the program that uses the Library does.
jeff@1016 379
jeff@1016 380 1. You may copy and distribute verbatim copies of the Library's
jeff@1016 381 complete source code as you receive it, in any medium, provided that
jeff@1016 382 you conspicuously and appropriately publish on each copy an
jeff@1016 383 appropriate copyright notice and disclaimer of warranty; keep intact
jeff@1016 384 all the notices that refer to this License and to the absence of any
jeff@1016 385 warranty; and distribute a copy of this License along with the
jeff@1016 386 Library.
jeff@1016 387
jeff@1016 388 You may charge a fee for the physical act of transferring a copy,
jeff@1016 389 and you may at your option offer warranty protection in exchange for a
jeff@1016 390 fee.
jeff@1016 391
jeff@1016 392 2. You may modify your copy or copies of the Library or any portion
jeff@1016 393 of it, thus forming a work based on the Library, and copy and
jeff@1016 394 distribute such modifications or work under the terms of Section 1
jeff@1016 395 above, provided that you also meet all of these conditions:
jeff@1016 396
jeff@1016 397 a) The modified work must itself be a software library.
jeff@1016 398
jeff@1016 399 b) You must cause the files modified to carry prominent notices
jeff@1016 400 stating that you changed the files and the date of any change.
jeff@1016 401
jeff@1016 402 c) You must cause the whole of the work to be licensed at no
jeff@1016 403 charge to all third parties under the terms of this License.
jeff@1016 404
jeff@1016 405 d) If a facility in the modified Library refers to a function or a
jeff@1016 406 table of data to be supplied by an application program that uses
jeff@1016 407 the facility, other than as an argument passed when the facility
jeff@1016 408 is invoked, then you must make a good faith effort to ensure that,
jeff@1016 409 in the event an application does not supply such function or
jeff@1016 410 table, the facility still operates, and performs whatever part of
jeff@1016 411 its purpose remains meaningful.
jeff@1016 412
jeff@1016 413 (For example, a function in a library to compute square roots has
jeff@1016 414 a purpose that is entirely well-defined independent of the
jeff@1016 415 application. Therefore, Subsection 2d requires that any
jeff@1016 416 application-supplied function or table used by this function must
jeff@1016 417 be optional: if the application does not supply it, the square
jeff@1016 418 root function must still compute square roots.)
jeff@1016 419
jeff@1016 420 These requirements apply to the modified work as a whole. If
jeff@1016 421 identifiable sections of that work are not derived from the Library,
jeff@1016 422 and can be reasonably considered independent and separate works in
jeff@1016 423 themselves, then this License, and its terms, do not apply to those
jeff@1016 424 sections when you distribute them as separate works. But when you
jeff@1016 425 distribute the same sections as part of a whole which is a work based
jeff@1016 426 on the Library, the distribution of the whole must be on the terms of
jeff@1016 427 this License, whose permissions for other licensees extend to the
jeff@1016 428 entire whole, and thus to each and every part regardless of who wrote
jeff@1016 429 it.
jeff@1016 430
jeff@1016 431 Thus, it is not the intent of this section to claim rights or contest
jeff@1016 432 your rights to work written entirely by you; rather, the intent is to
jeff@1016 433 exercise the right to control the distribution of derivative or
jeff@1016 434 collective works based on the Library.
jeff@1016 435
jeff@1016 436 In addition, mere aggregation of another work not based on the Library
jeff@1016 437 with the Library (or with a work based on the Library) on a volume of
jeff@1016 438 a storage or distribution medium does not bring the other work under
jeff@1016 439 the scope of this License.
jeff@1016 440
jeff@1016 441 3. You may opt to apply the terms of the ordinary GNU General Public
jeff@1016 442 License instead of this License to a given copy of the Library. To do
jeff@1016 443 this, you must alter all the notices that refer to this License, so
jeff@1016 444 that they refer to the ordinary GNU General Public License, version 2,
jeff@1016 445 instead of to this License. (If a newer version than version 2 of the
jeff@1016 446 ordinary GNU General Public License has appeared, then you can specify
jeff@1016 447 that version instead if you wish.) Do not make any other change in
jeff@1016 448 these notices.
jeff@1016 449
jeff@1016 450 Once this change is made in a given copy, it is irreversible for
jeff@1016 451 that copy, so the ordinary GNU General Public License applies to all
jeff@1016 452 subsequent copies and derivative works made from that copy.
jeff@1016 453
jeff@1016 454 This option is useful when you wish to copy part of the code of
jeff@1016 455 the Library into a program that is not a library.
jeff@1016 456
jeff@1016 457 4. You may copy and distribute the Library (or a portion or
jeff@1016 458 derivative of it, under Section 2) in object code or executable form
jeff@1016 459 under the terms of Sections 1 and 2 above provided that you accompany
jeff@1016 460 it with the complete corresponding machine-readable source code, which
jeff@1016 461 must be distributed under the terms of Sections 1 and 2 above on a
jeff@1016 462 medium customarily used for software interchange.
jeff@1016 463
jeff@1016 464 If distribution of object code is made by offering access to copy
jeff@1016 465 from a designated place, then offering equivalent access to copy the
jeff@1016 466 source code from the same place satisfies the requirement to
jeff@1016 467 distribute the source code, even though third parties are not
jeff@1016 468 compelled to copy the source along with the object code.
jeff@1016 469
jeff@1016 470 5. A program that contains no derivative of any portion of the
jeff@1016 471 Library, but is designed to work with the Library by being compiled or
jeff@1016 472 linked with it, is called a "work that uses the Library". Such a
jeff@1016 473 work, in isolation, is not a derivative work of the Library, and
jeff@1016 474 therefore falls outside the scope of this License.
jeff@1016 475
jeff@1016 476 However, linking a "work that uses the Library" with the Library
jeff@1016 477 creates an executable that is a derivative of the Library (because it
jeff@1016 478 contains portions of the Library), rather than a "work that uses the
jeff@1016 479 library". The executable is therefore covered by this License.
jeff@1016 480 Section 6 states terms for distribution of such executables.
jeff@1016 481
jeff@1016 482 When a "work that uses the Library" uses material from a header file
jeff@1016 483 that is part of the Library, the object code for the work may be a
jeff@1016 484 derivative work of the Library even though the source code is not.
jeff@1016 485 Whether this is true is especially significant if the work can be
jeff@1016 486 linked without the Library, or if the work is itself a library. The
jeff@1016 487 threshold for this to be true is not precisely defined by law.
jeff@1016 488
jeff@1016 489 If such an object file uses only numerical parameters, data
jeff@1016 490 structure layouts and accessors, and small macros and small inline
jeff@1016 491 functions (ten lines or less in length), then the use of the object
jeff@1016 492 file is unrestricted, regardless of whether it is legally a derivative
jeff@1016 493 work. (Executables containing this object code plus portions of the
jeff@1016 494 Library will still fall under Section 6.)
jeff@1016 495
jeff@1016 496 Otherwise, if the work is a derivative of the Library, you may
jeff@1016 497 distribute the object code for the work under the terms of Section 6.
jeff@1016 498 Any executables containing that work also fall under Section 6,
jeff@1016 499 whether or not they are linked directly with the Library itself.
jeff@1016 500
jeff@1016 501 6. As an exception to the Sections above, you may also combine or
jeff@1016 502 link a "work that uses the Library" with the Library to produce a
jeff@1016 503 work containing portions of the Library, and distribute that work
jeff@1016 504 under terms of your choice, provided that the terms permit
jeff@1016 505 modification of the work for the customer's own use and reverse
jeff@1016 506 engineering for debugging such modifications.
jeff@1016 507
jeff@1016 508 You must give prominent notice with each copy of the work that the
jeff@1016 509 Library is used in it and that the Library and its use are covered by
jeff@1016 510 this License. You must supply a copy of this License. If the work
jeff@1016 511 during execution displays copyright notices, you must include the
jeff@1016 512 copyright notice for the Library among them, as well as a reference
jeff@1016 513 directing the user to the copy of this License. Also, you must do one
jeff@1016 514 of these things:
jeff@1016 515
jeff@1016 516 a) Accompany the work with the complete corresponding
jeff@1016 517 machine-readable source code for the Library including whatever
jeff@1016 518 changes were used in the work (which must be distributed under
jeff@1016 519 Sections 1 and 2 above); and, if the work is an executable linked
jeff@1016 520 with the Library, with the complete machine-readable "work that
jeff@1016 521 uses the Library", as object code and/or source code, so that the
jeff@1016 522 user can modify the Library and then relink to produce a modified
jeff@1016 523 executable containing the modified Library. (It is understood
jeff@1016 524 that the user who changes the contents of definitions files in the
jeff@1016 525 Library will not necessarily be able to recompile the application
jeff@1016 526 to use the modified definitions.)
jeff@1016 527
jeff@1016 528 b) Use a suitable shared library mechanism for linking with the
jeff@1016 529 Library. A suitable mechanism is one that (1) uses at run time a
jeff@1016 530 copy of the library already present on the user's computer system,
jeff@1016 531 rather than copying library functions into the executable, and (2)
jeff@1016 532 will operate properly with a modified version of the library, if
jeff@1016 533 the user installs one, as long as the modified version is
jeff@1016 534 interface-compatible with the version that the work was made with.
jeff@1016 535
jeff@1016 536 c) Accompany the work with a written offer, valid for at
jeff@1016 537 least three years, to give the same user the materials
jeff@1016 538 specified in Subsection 6a, above, for a charge no more
jeff@1016 539 than the cost of performing this distribution.
jeff@1016 540
jeff@1016 541 d) If distribution of the work is made by offering access to copy
jeff@1016 542 from a designated place, offer equivalent access to copy the above
jeff@1016 543 specified materials from the same place.
jeff@1016 544
jeff@1016 545 e) Verify that the user has already received a copy of these
jeff@1016 546 materials or that you have already sent this user a copy.
jeff@1016 547
jeff@1016 548 For an executable, the required form of the "work that uses the
jeff@1016 549 Library" must include any data and utility programs needed for
jeff@1016 550 reproducing the executable from it. However, as a special exception,
jeff@1016 551 the materials to be distributed need not include anything that is
jeff@1016 552 normally distributed (in either source or binary form) with the major
jeff@1016 553 components (compiler, kernel, and so on) of the operating system on
jeff@1016 554 which the executable runs, unless that component itself accompanies
jeff@1016 555 the executable.
jeff@1016 556
jeff@1016 557 It may happen that this requirement contradicts the license
jeff@1016 558 restrictions of other proprietary libraries that do not normally
jeff@1016 559 accompany the operating system. Such a contradiction means you cannot
jeff@1016 560 use both them and the Library together in an executable that you
jeff@1016 561 distribute.
jeff@1016 562
jeff@1016 563 7. You may place library facilities that are a work based on the
jeff@1016 564 Library side-by-side in a single library together with other library
jeff@1016 565 facilities not covered by this License, and distribute such a combined
jeff@1016 566 library, provided that the separate distribution of the work based on
jeff@1016 567 the Library and of the other library facilities is otherwise
jeff@1016 568 permitted, and provided that you do these two things:
jeff@1016 569
jeff@1016 570 a) Accompany the combined library with a copy of the same work
jeff@1016 571 based on the Library, uncombined with any other library
jeff@1016 572 facilities. This must be distributed under the terms of the
jeff@1016 573 Sections above.
jeff@1016 574
jeff@1016 575 b) Give prominent notice with the combined library of the fact
jeff@1016 576 that part of it is a work based on the Library, and explaining
jeff@1016 577 where to find the accompanying uncombined form of the same work.
jeff@1016 578
jeff@1016 579 8. You may not copy, modify, sublicense, link with, or distribute
jeff@1016 580 the Library except as expressly provided under this License. Any
jeff@1016 581 attempt otherwise to copy, modify, sublicense, link with, or
jeff@1016 582 distribute the Library is void, and will automatically terminate your
jeff@1016 583 rights under this License. However, parties who have received copies,
jeff@1016 584 or rights, from you under this License will not have their licenses
jeff@1016 585 terminated so long as such parties remain in full compliance.
jeff@1016 586
jeff@1016 587 9. You are not required to accept this License, since you have not
jeff@1016 588 signed it. However, nothing else grants you permission to modify or
jeff@1016 589 distribute the Library or its derivative works. These actions are
jeff@1016 590 prohibited by law if you do not accept this License. Therefore, by
jeff@1016 591 modifying or distributing the Library (or any work based on the
jeff@1016 592 Library), you indicate your acceptance of this License to do so, and
jeff@1016 593 all its terms and conditions for copying, distributing or modifying
jeff@1016 594 the Library or works based on it.
jeff@1016 595
jeff@1016 596 10. Each time you redistribute the Library (or any work based on the
jeff@1016 597 Library), the recipient automatically receives a license from the
jeff@1016 598 original licensor to copy, distribute, link with or modify the Library
jeff@1016 599 subject to these terms and conditions. You may not impose any further
jeff@1016 600 restrictions on the recipients' exercise of the rights granted herein.
jeff@1016 601 You are not responsible for enforcing compliance by third parties with
jeff@1016 602 this License.
jeff@1016 603
jeff@1016 604 11. If, as a consequence of a court judgment or allegation of patent
jeff@1016 605 infringement or for any other reason (not limited to patent issues),
jeff@1016 606 conditions are imposed on you (whether by court order, agreement or
jeff@1016 607 otherwise) that contradict the conditions of this License, they do not
jeff@1016 608 excuse you from the conditions of this License. If you cannot
jeff@1016 609 distribute so as to satisfy simultaneously your obligations under this
jeff@1016 610 License and any other pertinent obligations, then as a consequence you
jeff@1016 611 may not distribute the Library at all. For example, if a patent
jeff@1016 612 license would not permit royalty-free redistribution of the Library by
jeff@1016 613 all those who receive copies directly or indirectly through you, then
jeff@1016 614 the only way you could satisfy both it and this License would be to
jeff@1016 615 refrain entirely from distribution of the Library.
jeff@1016 616
jeff@1016 617 If any portion of this section is held invalid or unenforceable under any
jeff@1016 618 particular circumstance, the balance of the section is intended to apply,
jeff@1016 619 and the section as a whole is intended to apply in other circumstances.
jeff@1016 620
jeff@1016 621 It is not the purpose of this section to induce you to infringe any
jeff@1016 622 patents or other property right claims or to contest validity of any
jeff@1016 623 such claims; this section has the sole purpose of protecting the
jeff@1016 624 integrity of the free software distribution system which is
jeff@1016 625 implemented by public license practices. Many people have made
jeff@1016 626 generous contributions to the wide range of software distributed
jeff@1016 627 through that system in reliance on consistent application of that
jeff@1016 628 system; it is up to the author/donor to decide if he or she is willing
jeff@1016 629 to distribute software through any other system and a licensee cannot
jeff@1016 630 impose that choice.
jeff@1016 631
jeff@1016 632 This section is intended to make thoroughly clear what is believed to
jeff@1016 633 be a consequence of the rest of this License.
jeff@1016 634
jeff@1016 635 12. If the distribution and/or use of the Library is restricted in
jeff@1016 636 certain countries either by patents or by copyrighted interfaces, the
jeff@1016 637 original copyright holder who places the Library under this License may add
jeff@1016 638 an explicit geographical distribution limitation excluding those countries,
jeff@1016 639 so that distribution is permitted only in or among countries not thus
jeff@1016 640 excluded. In such case, this License incorporates the limitation as if
jeff@1016 641 written in the body of this License.
jeff@1016 642
jeff@1016 643 13. The Free Software Foundation may publish revised and/or new
jeff@1016 644 versions of the Lesser General Public License from time to time.
jeff@1016 645 Such new versions will be similar in spirit to the present version,
jeff@1016 646 but may differ in detail to address new problems or concerns.
jeff@1016 647
jeff@1016 648 Each version is given a distinguishing version number. If the Library
jeff@1016 649 specifies a version number of this License which applies to it and
jeff@1016 650 "any later version", you have the option of following the terms and
jeff@1016 651 conditions either of that version or of any later version published by
jeff@1016 652 the Free Software Foundation. If the Library does not specify a
jeff@1016 653 license version number, you may choose any version ever published by
jeff@1016 654 the Free Software Foundation.
jeff@1016 655
jeff@1016 656 14. If you wish to incorporate parts of the Library into other free
jeff@1016 657 programs whose distribution conditions are incompatible with these,
jeff@1016 658 write to the author to ask for permission. For software which is
jeff@1016 659 copyrighted by the Free Software Foundation, write to the Free
jeff@1016 660 Software Foundation; we sometimes make exceptions for this. Our
jeff@1016 661 decision will be guided by the two goals of preserving the free status
jeff@1016 662 of all derivatives of our free software and of promoting the sharing
jeff@1016 663 and reuse of software generally.
jeff@1016 664
jeff@1016 665 NO WARRANTY
jeff@1016 666
jeff@1016 667 15. BECAUSE THE LIBRARY IS LICENSED FREE OF CHARGE, THERE IS NO
jeff@1016 668 WARRANTY FOR THE LIBRARY, TO THE EXTENT PERMITTED BY APPLICABLE LAW.
jeff@1016 669 EXCEPT WHEN OTHERWISE STATED IN WRITING THE COPYRIGHT HOLDERS AND/OR
jeff@1016 670 OTHER PARTIES PROVIDE THE LIBRARY "AS IS" WITHOUT WARRANTY OF ANY
jeff@1016 671 KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE
jeff@1016 672 IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR
jeff@1016 673 PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE
jeff@1016 674 LIBRARY IS WITH YOU. SHOULD THE LIBRARY PROVE DEFECTIVE, YOU ASSUME
jeff@1016 675 THE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.
jeff@1016 676
jeff@1016 677 16. IN NO EVENT UNLESS REQUIRED BY APPLICABLE LAW OR AGREED TO IN
jeff@1016 678 WRITING WILL ANY COPYRIGHT HOLDER, OR ANY OTHER PARTY WHO MAY MODIFY
jeff@1016 679 AND/OR REDISTRIBUTE THE LIBRARY AS PERMITTED ABOVE, BE LIABLE TO YOU
jeff@1016 680 FOR DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL OR
jeff@1016 681 CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE
jeff@1016 682 LIBRARY (INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA BEING
jeff@1016 683 RENDERED INACCURATE OR LOSSES SUSTAINED BY YOU OR THIRD PARTIES OR A
jeff@1016 684 FAILURE OF THE LIBRARY TO OPERATE WITH ANY OTHER SOFTWARE), EVEN IF
jeff@1016 685 SUCH HOLDER OR OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
jeff@1016 686 DAMAGES.
jeff@1016 687
jeff@1016 688 END OF TERMS AND CONDITIONS
jeff@1016 689
jeff@1016 690 How to Apply These Terms to Your New Libraries
jeff@1016 691
jeff@1016 692 If you develop a new library, and you want it to be of the greatest
jeff@1016 693 possible use to the public, we recommend making it free software that
jeff@1016 694 everyone can redistribute and change. You can do so by permitting
jeff@1016 695 redistribution under these terms (or, alternatively, under the terms of the
jeff@1016 696 ordinary General Public License).
jeff@1016 697
jeff@1016 698 To apply these terms, attach the following notices to the library. It is
jeff@1016 699 safest to attach them to the start of each source file to most effectively
jeff@1016 700 convey the exclusion of warranty; and each file should have at least the
jeff@1016 701 "copyright" line and a pointer to where the full notice is found.
jeff@1016 702
jeff@1016 703 <one line to give the library's name and a brief idea of what it does.>

jeff@1016 706 This library is free software; you can redistribute it and/or
jeff@1016 707 modify it under the terms of the GNU Lesser General Public
jeff@1016 708 License as published by the Free Software Foundation; either
jeff@1016 709 version 2.1 of the License, or (at your option) any later version.
jeff@1016 710
jeff@1016 711 This library is distributed in the hope that it will be useful,

jeff@1016 720 Also add information on how to contact you by electronic and paper mail.
jeff@1016 721
jeff@1016 722 You should also get your employer (if you work as a programmer) or your

jeff@1016 724 necessary. Here is a sample; alter the names:

jeff@1016 1489 governed by the terms of this License, including without limitation
jeff@1016 1490 Section 2.2. The Source Code version of Covered Code may be
jeff@1016 1491 distributed only under the terms of this License or a future version
jeff@1016 1492 of this License released under Section 6.1, and You must include a
jeff@1016 1493 copy of this License with every copy of the Source Code You
jeff@1016 1494 distribute. You may not offer or impose any terms on any Source Code
jeff@1016 1495 version that alters or restricts the applicable version of this
jeff@1016 1496 License or the recipients' rights hereunder. However, You may include
jeff@1016 1497 an additional document offering the additional rights described in
jeff@1016 1498 Section 3.5.
jeff@1016 1499
jeff@1016 1500 3.2. Availability of Source Code.
jeff@1016 1501 Any Modification which You create or to which You contribute must be
jeff@1016 1502 made available in Source Code form under the terms of this License
jeff@1016 1503 either on the same media as an Executable version or via an accepted
jeff@1016 1504 Electronic Distribution Mechanism to anyone to whom you made an
jeff@1016 1505 Executable version available; and if made available via Electronic
jeff@1016 1506 Distribution Mechanism, must remain available for at least twelve (12)
jeff@1016 1507 months after the date it initially became available, or at least six
jeff@1016 1508 (6) months after a subsequent version of that particular Modification
jeff@1016 1509 has been made available to such recipients. You are responsible for
jeff@1016 1510 ensuring that the Source Code version remains available even if the
jeff@1016 1511 Electronic Distribution Mechanism is maintained by a third party.
jeff@1016 1512
jeff@1016 1513 3.3. Description of Modifications.
jeff@1016 1514 You must cause all Covered Code to which You contribute to contain a
jeff@1016 1515 file documenting the changes You made to create that Covered Code and
jeff@1016 1516 the date of any change. You must include a prominent statement that
jeff@1016 1517 the Modification is derived, directly or indirectly, from Original
jeff@1016 1518 Code provided by the Initial Developer and including the name of the
jeff@1016 1519 Initial Developer in (a) the Source Code, and (b) in any notice in an
jeff@1016 1520 Executable version or related documentation in which You describe the
jeff@1016 1521 origin or ownership of the Covered Code.
jeff@1016 1522
jeff@1016 1523 3.4. Intellectual Property Matters
jeff@1016 1524 (a) Third Party Claims.
jeff@1016 1525 If Contributor has knowledge that a license under a third party's
jeff@1016 1526 intellectual property rights is required to exercise the rights
jeff@1016 1527 granted by such Contributor under Sections 2.1 or 2.2,
jeff@1016 1528 Contributor must include a text file with the Source Code
jeff@1016 1529 distribution titled "LEGAL" which describes the claim and the
jeff@1016 1530 party making the claim in sufficient detail that a recipient will
jeff@1016 1531 know whom to contact. If Contributor obtains such knowledge after
jeff@1016 1532 the Modification is made available as described in Section 3.2,
jeff@1016 1533 Contributor shall promptly modify the LEGAL file in all copies
jeff@1016 1534 Contributor makes available thereafter and shall take other steps
jeff@1016 1535 (such as notifying appropriate mailing lists or newsgroups)
jeff@1016 1536 reasonably calculated to inform those who received the Covered
jeff@1016 1537 Code that new knowledge has been obtained.
jeff@1016 1538
jeff@1016 1539 (b) Contributor APIs.
jeff@1016 1540 If Contributor's Modifications include an application programming
jeff@1016 1541 interface and Contributor has knowledge of patent licenses which
jeff@1016 1542 are reasonably necessary to implement that API, Contributor must
jeff@1016 1543 also include this information in the LEGAL file.
jeff@1016 1544
jeff@1016 1545 (c) Representations.
jeff@1016 1546 Contributor represents that, except as disclosed pursuant to
jeff@1016 1547 Section 3.4(a) above, Contributor believes that Contributor's
jeff@1016 1548 Modifications are Contributor's original creation(s) and/or
jeff@1016 1549 Contributor has sufficient rights to grant the rights conveyed by
jeff@1016 1550 this License.
jeff@1016 1551
jeff@1016 1552 3.5. Required Notices.
jeff@1016 1553 You must duplicate the notice in Exhibit A in each file of the Source
jeff@1016 1554 Code. If it is not possible to put such notice in a particular Source
jeff@1016 1555 Code file due to its structure, then You must include such notice in a
jeff@1016 1556 location (such as a relevant directory) where a user would be likely
jeff@1016 1557 to look for such a notice. If You created one or more Modification(s)
jeff@1016 1558 You may add your name as a Contributor to the notice described in
jeff@1016 1559 Exhibit A. You must also duplicate this License in any documentation
jeff@1016 1560 for the Source Code where You describe recipients' rights or ownership
jeff@1016 1561 rights relating to Covered Code. You may choose to offer, and to
jeff@1016 1562 charge a fee for, warranty, support, indemnity or liability
jeff@1016 1563 obligations to one or more recipients of Covered Code. However, You
jeff@1016 1564 may do so only on Your own behalf, and not on behalf of the Initial
jeff@1016 1565 Developer or any Contributor. You must make it absolutely clear than
jeff@1016 1566 any such warranty, support, indemnity or liability obligation is
jeff@1016 1567 offered by You alone, and You hereby agree to indemnify the Initial
jeff@1016 1568 Developer and every Contributor for any liability incurred by the
jeff@1016 1569 Initial Developer or such Contributor as a result of warranty,
jeff@1016 1570 support, indemnity or liability terms You offer.
jeff@1016 1571
jeff@1016 1572 3.6. Distribution of Executable Versions.
jeff@1016 1573 You may distribute Covered Code in Executable form only if the
jeff@1016 1574 requirements of Section 3.1-3.5 have been met for that Covered Code,
jeff@1016 1575 and if You include a notice stating that the Source Code version of
jeff@1016 1576 the Covered Code is available under the terms of this License,
jeff@1016 1577 including a description of how and where You have fulfilled the
jeff@1016 1578 obligations of Section 3.2. The notice must be conspicuously included
jeff@1016 1579 in any notice in an Executable version, related documentation or
jeff@1016 1580 collateral in which You describe recipients' rights relating to the
jeff@1016 1581 Covered Code. You may distribute the Executable version of Covered
jeff@1016 1582 Code or ownership rights under a license of Your choice, which may
jeff@1016 1583 contain terms different from this License, provided that You are in
jeff@1016 1584 compliance with the terms of this License and that the license for the
jeff@1016 1585 Executable version does not attempt to limit or alter the recipient's
jeff@1016 1586 rights in the Source Code version from the rights set forth in this
jeff@1016 1587 License. If You distribute the Executable version under a different
jeff@1016 1588 license You must make it absolutely clear that any terms which differ
jeff@1016 1589 from this License are offered by You alone, not by the Initial
jeff@1016 1590 Developer or any Contributor. You hereby agree to indemnify the
jeff@1016 1591 Initial Developer and every Contributor for any liability incurred by
jeff@1016 1592 the Initial Developer or such Contributor as a result of any such
jeff@1016 1593 terms You offer.
jeff@1016 1594
jeff@1016 1595 3.7. Larger Works.
jeff@1016 1596 You may create a Larger Work by combining Covered Code with other code
jeff@1016 1597 not governed by the terms of this License and distribute the Larger
jeff@1016 1598 Work as a single product. In such a case, You must make sure the
jeff@1016 1599 requirements of this License are fulfilled for the Covered Code.
jeff@1016 1600
jeff@1016 1601 4. Inability to Comply Due to Statute or Regulation.
jeff@1016 1602
jeff@1016 1603 If it is impossible for You to comply with any of the terms of this
jeff@1016 1604 License with respect to some or all of the Covered Code due to
jeff@1016 1605 statute, judicial order, or regulation then You must: (a) comply with
jeff@1016 1606 the terms of this License to the maximum extent possible; and (b)
jeff@1016 1607 describe the limitations and the code they affect. Such description
jeff@1016 1608 must be included in the LEGAL file described in Section 3.4 and must
jeff@1016 1609 be included with all distributions of the Source Code. Except to the
jeff@1016 1610 extent prohibited by statute or regulation, such description must be
jeff@1016 1611 sufficiently detailed for a recipient of ordinary skill to be able to
jeff@1016 1612 understand it.
jeff@1016 1613
jeff@1016 1614 5. Application of this License.
jeff@1016 1615
jeff@1016 1616 This License applies to code to which the Initial Developer has
jeff@1016 1617 attached the notice in Exhibit A and to related Covered Code.
jeff@1016 1618
jeff@1016 1619 6. Versions of the License.
jeff@1016 1620
jeff@1016 1621 6.1. New Versions.
jeff@1016 1622 Netscape Communications Corporation ("Netscape") may publish revised
jeff@1016 1623 and/or new versions of the License from time to time. Each version
jeff@1016 1624 will be given a distinguishing version number.
jeff@1016 1625
jeff@1016 1626 6.2. Effect of New Versions.
jeff@1016 1627 Once Covered Code has been published under a particular version of the
jeff@1016 1628 License, You may always continue to use it under the terms of that
jeff@1016 1629 version. You may also choose to use such Covered Code under the terms
jeff@1016 1630 of any subsequent version of the License published by Netscape. No one
jeff@1016 1631 other than Netscape has the right to modify the terms applicable to
jeff@1016 1632 Covered Code created under this License.
jeff@1016 1633
jeff@1016 1634 6.3. Derivative Works.
jeff@1016 1635 If You create or use a modified version of this License (which you may
jeff@1016 1636 only do in order to apply it to code which is not already Covered Code
jeff@1016 1637 governed by this License), You must (a) rename Your license so that
jeff@1016 1638 the phrases "Mozilla", "MOZILLAPL", "MOZPL", "Netscape",
jeff@1016 1639 "MPL", "NPL" or any confusingly similar phrase do not appear in your
jeff@1016 1640 license (except to note that your license differs from this License)
jeff@1016 1641 and (b) otherwise make it clear that Your version of the license
jeff@1016 1642 contains terms which differ from the Mozilla Public License and
jeff@1016 1643 Netscape Public License. (Filling in the name of the Initial
jeff@1016 1644 Developer, Original Code or Contributor in the notice described in
jeff@1016 1645 Exhibit A shall not of themselves be deemed to be modifications of
jeff@1016 1646 this License.)
jeff@1016 1647
jeff@1016 1648 7. DISCLAIMER OF WARRANTY.
jeff@1016 1649
jeff@1016 1650 COVERED CODE IS PROVIDED UNDER THIS LICENSE ON AN "AS IS" BASIS,
jeff@1016 1651 WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING,
jeff@1016 1652 WITHOUT LIMITATION, WARRANTIES THAT THE COVERED CODE IS FREE OF
jeff@1016 1653 DEFECTS, MERCHANTABLE, FIT FOR A PARTICULAR PURPOSE OR NON-INFRINGING.
jeff@1016 1654 THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE COVERED CODE
jeff@1016 1655 IS WITH YOU. SHOULD ANY COVERED CODE PROVE DEFECTIVE IN ANY RESPECT,
jeff@1016 1656 YOU (NOT THE INITIAL DEVELOPER OR ANY OTHER CONTRIBUTOR) ASSUME THE
jeff@1016 1657 COST OF ANY NECESSARY SERVICING, REPAIR OR CORRECTION. THIS DISCLAIMER
jeff@1016 1658 OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THIS LICENSE. NO USE OF
jeff@1016 1659 ANY COVERED CODE IS AUTHORIZED HEREUNDER EXCEPT UNDER THIS DISCLAIMER.
jeff@1016 1660
jeff@1016 1661 8. TERMINATION.
jeff@1016 1662
jeff@1016 1663 8.1. This License and the rights granted hereunder will terminate
jeff@1016 1664 automatically if You fail to comply with terms herein and fail to cure
jeff@1016 1665 such breach within 30 days of becoming aware of the breach. All
jeff@1016 1666 sublicenses to the Covered Code which are properly granted shall
jeff@1016 1667 survive any termination of this License. Provisions which, by their
jeff@1016 1668 nature, must remain in effect beyond the termination of this License
jeff@1016 1669 shall survive.
jeff@1016 1670
jeff@1016 1671 8.2. If You initiate litigation by asserting a patent infringement
jeff@1016 1672 claim (excluding declatory judgment actions) against Initial Developer
jeff@1016 1673 or a Contributor (the Initial Developer or Contributor against whom
jeff@1016 1674 You file such action is referred to as "Participant") alleging that:
jeff@1016 1675
jeff@1016 1676 (a) such Participant's Contributor Version directly or indirectly
jeff@1016 1677 infringes any patent, then any and all rights granted by such
jeff@1016 1678 Participant to You under Sections 2.1 and/or 2.2 of this License
jeff@1016 1679 shall, upon 60 days notice from Participant terminate prospectively,
jeff@1016 1680 unless if within 60 days after receipt of notice You either: (i)
jeff@1016 1681 agree in writing to pay Participant a mutually agreeable reasonable
jeff@1016 1682 royalty for Your past and future use of Modifications made by such
jeff@1016 1683 Participant, or (ii) withdraw Your litigation claim with respect to
jeff@1016 1684 the Contributor Version against such Participant. If within 60 days
jeff@1016 1685 of notice, a reasonable royalty and payment arrangement are not
jeff@1016 1686 mutually agreed upon in writing by the parties or the litigation claim
jeff@1016 1687 is not withdrawn, the rights granted by Participant to You under
jeff@1016 1688 Sections 2.1 and/or 2.2 automatically terminate at the expiration of
jeff@1016 1689 the 60 day notice period specified above.
jeff@1016 1690
jeff@1016 1691 (b) any software, hardware, or device, other than such Participant's
jeff@1016 1692 Contributor Version, directly or indirectly infringes any patent, then
jeff@1016 1693 any rights granted to You by such Participant under Sections 2.1(b)
jeff@1016 1694 and 2.2(b) are revoked effective as of the date You first made, used,
jeff@1016 1695 sold, distributed, or had made, Modifications made by that
jeff@1016 1696 Participant.
jeff@1016 1697
jeff@1016 1698 8.3. If You assert a patent infringement claim against Participant
jeff@1016 1699 alleging that such Participant's Contributor Version directly or
jeff@1016 1700 indirectly infringes any patent where such claim is resolved (such as
jeff@1016 1701 by license or settlement) prior to the initiation of patent
jeff@1016 1702 infringement litigation, then the reasonable value of the licenses
jeff@1016 1703 granted by such Participant under Sections 2.1 or 2.2 shall be taken
jeff@1016 1704 into account in determining the amount or value of any payment or
jeff@1016 1705 license.
jeff@1016 1706
jeff@1016 1707 8.4. In the event of termination under Sections 8.1 or 8.2 above,
jeff@1016 1708 all end user license agreements (excluding distributors and resellers)
jeff@1016 1709 which have been validly granted by You or any distributor hereunder
jeff@1016 1710 prior to termination shall survive termination.
jeff@1016 1711
jeff@1016 1712 9. LIMITATION OF LIABILITY.
jeff@1016 1713
jeff@1016 1714 UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, WHETHER TORT
jeff@1016 1715 (INCLUDING NEGLIGENCE), CONTRACT, OR OTHERWISE, SHALL YOU, THE INITIAL
jeff@1016 1716 DEVELOPER, ANY OTHER CONTRIBUTOR, OR ANY DISTRIBUTOR OF COVERED CODE,
jeff@1016 1717 OR ANY SUPPLIER OF ANY OF SUCH PARTIES, BE LIABLE TO ANY PERSON FOR
jeff@1016 1718 ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY
jeff@1016 1719 CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL,
jeff@1016 1720 WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER
jeff@1016 1721 COMMERCIAL DAMAGES OR LOSSES, EVEN IF SUCH PARTY SHALL HAVE BEEN
jeff@1016 1722 INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION OF
jeff@1016 1723 LIABILITY SHALL NOT APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY
jeff@1016 1724 RESULTING FROM SUCH PARTY'S NEGLIGENCE TO THE EXTENT APPLICABLE LAW
jeff@1016 1725 PROHIBITS SUCH LIMITATION. SOME JURISDICTIONS DO NOT ALLOW THE
jeff@1016 1726 EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO
jeff@1016 1727 THIS EXCLUSION AND LIMITATION MAY NOT APPLY TO YOU.
jeff@1016 1728
jeff@1016 1729 10. U.S. GOVERNMENT END USERS.
jeff@1016 1730
jeff@1016 1731 The Covered Code is a "commercial item," as that term is defined in
jeff@1016 1732 48 C.F.R. 2.101 (Oct. 1995), consisting of "commercial computer
jeff@1016 1733 software" and "commercial computer software documentation," as such
jeff@1016 1734 terms are used in 48 C.F.R. 12.212 (Sept. 1995). Consistent with 48
jeff@1016 1735 C.F.R. 12.212 and 48 C.F.R. 227.7202-1 through 227.7202-4 (June 1995),
jeff@1016 1736 all U.S. Government End Users acquire Covered Code with only those
jeff@1016 1737 rights set forth herein.
jeff@1016 1738
jeff@1016 1739 11. MISCELLANEOUS.
jeff@1016 1740
jeff@1016 1741 This License represents the complete agreement concerning subject
jeff@1016 1742 matter hereof. If any provision of this License is held to be
jeff@1016 1743 unenforceable, such provision shall be reformed only to the extent
jeff@1016 1744 necessary to make it enforceable. This License shall be governed by
jeff@1016 1745 California law provisions (except to the extent applicable law, if
jeff@1016 1746 any, provides otherwise), excluding its conflict-of-law provisions.
jeff@1016 1747 With respect to disputes in which at least one party is a citizen of,
jeff@1016 1748 or an entity chartered or registered to do business in the United
jeff@1016 1749 States of America, any litigation relating to this License shall be
jeff@1016 1750 subject to the jurisdiction of the Federal Courts of the Northern
jeff@1016 1751 District of California, with venue lying in Santa Clara County,
jeff@1016 1752 California, with the losing party responsible for costs, including
jeff@1016 1753 without limitation, court costs and reasonable attorneys' fees and
jeff@1016 1754 expenses. The application of the United Nations Convention on
jeff@1016 1755 Contracts for the International Sale of Goods is expressly excluded.
jeff@1016 1756 Any law or regulation which provides that the language of a contract
jeff@1016 1757 shall be construed against the drafter shall not apply to this
jeff@1016 1758 License.
jeff@1016 1759
jeff@1016 1760 12. RESPONSIBILITY FOR CLAIMS.
jeff@1016 1761
jeff@1016 1762 As between Initial Developer and the Contributors, each party is
jeff@1016 1763 responsible for claims and damages arising, directly or indirectly,
jeff@1016 1764 out of its utilization of rights under this License and You agree to
jeff@1016 1765 work with Initial Developer and Contributors to distribute such
jeff@1016 1766 responsibility on an equitable basis. Nothing herein is intended or
jeff@1016 1767 shall be deemed to constitute any admission of liability.
jeff@1016 1768
jeff@1016 1769 13. MULTIPLE-LICENSED CODE.
jeff@1016 1770
jeff@1016 1771 Initial Developer may designate portions of the Covered Code as
jeff@1016 1772 "Multiple-Licensed". "Multiple-Licensed" means that the Initial
jeff@1016 1773 Developer permits you to utilize portions of the Covered Code under
jeff@1016 1774 Your choice of the NPL or the alternative licenses, if any, specified
jeff@1016 1775 by the Initial Developer in the file described in Exhibit A.

jeff@1016 2209 SPECIAL EXCEPTION FOR COMPRESSED EXECUTABLES
jeff@1016 2210 ============================================
jeff@1016 2211
jeff@1016 2212 The stub which is imbedded in each UPX compressed program is part
jeff@1016 2213 of UPX and UCL, and contains code that is under our copyright. The
jeff@1016 2214 terms of the GNU General Public License still apply as compressing
jeff@1016 2215 a program is a special form of linking with our stub.
jeff@1016 2216
jeff@1016 2217 Hereby Markus F.X.J. Oberhumer and Laszlo Molnar grant you special
jeff@1016 2218 permission to freely use and distribute all UPX compressed programs
jeff@1016 2219 (including commercial ones), subject to the following restrictions:
jeff@1016 2220
jeff@1016 2221 1. You must compress your program with a completely unmodified UPX
jeff@1016 2222 version; either with our precompiled version, or (at your option)
jeff@1016 2223 with a self compiled version of the unmodified UPX sources as
jeff@1016 2224 distributed by us.
jeff@1016 2225 2. This also implies that the UPX stub must be completely unmodfied, i.e.
jeff@1016 2226 the stub imbedded in your compressed program must be byte-identical
jeff@1016 2227 to the stub that is produced by the official unmodified UPX version.
jeff@1016 2228 3. The decompressor and any other code from the stub must exclusively get
jeff@1016 2229 used by the unmodified UPX stub for decompressing your program at
jeff@1016 2230 program startup. No portion of the stub may get read, copied,
jeff@1016 2231 called or otherwise get used or accessed by your program.
jeff@1016 2232
jeff@1016 2233
jeff@1016 2234 ANNOTATIONS
jeff@1016 2235 ===========
jeff@1016 2236
jeff@1016 2237 - You can use a modified UPX version or modified UPX stub only for
jeff@1016 2238 programs that are compatible with the GNU General Public License.
jeff@1016 2239
jeff@1016 2240 - We grant you special permission to freely use and distribute all UPX
jeff@1016 2241 compressed programs. But any modification of the UPX stub (such as,
jeff@1016 2242 but not limited to, removing our copyright string or making your
jeff@1016 2243 program non-decompressible) will immediately revoke your right to
jeff@1016 2244 use and distribute a UPX compressed program.
jeff@1016 2245
jeff@1016 2246 - UPX is not a software protection tool; by requiring that you use
jeff@1016 2247 the unmodified UPX version for your proprietary programs we
jeff@1016 2248 make sure that any user can decompress your program. This protects
jeff@1016 2249 both you and your users as nobody can hide malicious code -
jeff@1016 2250 any program that cannot be decompressed is highly suspicious
jeff@1016 2251 by definition.
jeff@1016 2252
jeff@1016 2253 - You can integrate all or part of UPX and UCL into projects that
jeff@1016 2254 are compatible with the GNU GPL, but obviously you cannot grant
jeff@1016 2255 any special exceptions beyond the GPL for our code in your project.
jeff@1016 2256
jeff@1016 2257 - We want to actively support manufacturers of virus scanners and
jeff@1016 2258 similar security software. Please contact us if you would like to
jeff@1016 2259 incorporate parts of UPX or UCL into such a product.

jeff@1016 2337 1. Introduction
jeff@1016 2338
jeff@1016 2339 The X.org Foundation X Window System distribution is a compilation of code and
jeff@1016 2340 documentation from many sources. This document is intended primarily as a
jeff@1016 2341 guide to the licenses used in the distribution: you must check each file
jeff@1016 2342 and/or package for precise redistribution terms. None-the-less, this summary
jeff@1016 2343 may be useful to many users. No software incorporating the XFree86 1.1 license
jeff@1016 2344 has been incorporated.

jeff@1016 2658 Subject to any third party claims, Silicon Graphics, Inc. ("SGI") hereby
jeff@1016 2659 grants permission to Recipient (defined below), under Recipient's copyrights
jeff@1016 2660 in the Original Software (defined below), to use, copy, modify, merge,
jeff@1016 2661 publish, distribute, sublicense and/or sell copies of Subject Software
jeff@1016 2662 (defined below), and to permit persons to whom the Subject Software is
jeff@1016 2663 furnished in accordance with this License to do the same, subject to all of
jeff@1016 2664 the following terms and conditions, which Recipient accepts by engaging in any
jeff@1016 2665 such use, copying, modifying, merging, publishing, distributing, sublicensing
jeff@1016 2666 or selling:
jeff@1016 2667
jeff@1016 2668 1. Definitions.
jeff@1016 2669
jeff@1016 2670 (a) "Original Software" means source code of computer software code which
jeff@1016 2671 is described in Exhibit A as Original Software.
jeff@1016 2672
jeff@1016 2673 (b) "Modifications" means any addition to or deletion from the substance
jeff@1016 2674 or structure of either the Original Software or any previous
jeff@1016 2675 Modifications. When Subject Software is released as a series of files, a
jeff@1016 2676 Modification means (i) any addition to or deletion from the contents of a
jeff@1016 2677 file containing Original Software or previous Modifications and (ii) any
jeff@1016 2678 new file that contains any part of the Original Code or previous
jeff@1016 2679 Modifications.
jeff@1016 2680
jeff@1016 2681 (c) "Subject Software" means the Original Software or Modifications or the
jeff@1016 2682 combination of the Original Software and Modifications, or portions of any
jeff@1016 2683 of the foregoing.
jeff@1016 2684
jeff@1016 2685 (d) "Recipient" means an individual or a legal entity exercising rights
jeff@1016 2686 under, and complying with all of the terms of, this License. For legal
jeff@1016 2687 entities, "Recipient" includes any entity which controls, is controlled
jeff@1016 2688 by, or is under common control with Recipient. For purposes of this
jeff@1016 2689 definition, "control" of an entity means (a) the power, direct or
jeff@1016 2690 indirect, to direct or manage such entity, or (b) ownership of fifty
jeff@1016 2691 percent (50%) or more of the outstanding shares or beneficial ownership of
jeff@1016 2692 such entity.
jeff@1016 2693
jeff@1016 2694 2. Redistribution of Source Code Subject to These Terms. Redistributions of
jeff@1016 2695 Subject Software in source code form must retain the notice set forth in
jeff@1016 2696 Exhibit A, below, in every file. A copy of this License must be included in
jeff@1016 2697 any documentation for such Subject Software where the recipients' rights
jeff@1016 2698 relating to Subject Software are described. Recipient may distribute the
jeff@1016 2699 source code version of Subject Software under a license of Recipient's choice,
jeff@1016 2700 which may contain terms different from this License, provided that (i)
jeff@1016 2701 Recipient is in compliance with the terms of this License, and (ii) the
jeff@1016 2702 license terms include this Section 2 and Sections 3, 4, 7, 8, 10, 12 and 13 of
jeff@1016 2703 this License, which terms may not be modified or superseded by any other terms
jeff@1016 2704 of such license. If Recipient distributes the source code version under a
jeff@1016 2705 different license Recipient must make it absolutely clear that any terms which
jeff@1016 2706 differ from this License are offered by Recipient alone, not by SGI. Recipient
jeff@1016 2707 hereby agrees to indemnify SGI for any liability incurred by SGI as a result
jeff@1016 2708 of any such terms Recipient offers.
jeff@1016 2709
jeff@1016 2710 3. Redistribution in Executable Form. The notice set forth in Exhibit A must
jeff@1016 2711 be conspicuously included in any notice in an executable version of Subject
jeff@1016 2712 Software, related documentation or collateral in which Recipient describes the
jeff@1016 2713 user's rights relating to the Subject Software. Recipient may distribute the
jeff@1016 2714 executable version of Subject Software under a license of Recipient's choice,
jeff@1016 2715 which may contain terms different from this License, provided that (i)
jeff@1016 2716 Recipient is in compliance with the terms of this License, and (ii) the
jeff@1016 2717 license terms include this Section 3 and Sections 4, 7, 8, 10, 12 and 13 of
jeff@1016 2718 this License, which terms may not be modified or superseded by any other terms
jeff@1016 2719 of such license. If Recipient distributes the executable version under a
jeff@1016 2720 different license Recipient must make it absolutely clear that any terms which
jeff@1016 2721 differ from this License are offered by Recipient alone, not by SGI. Recipient
jeff@1016 2722 hereby agrees to indemnify SGI for any liability incurred by SGI as a result
jeff@1016 2723 of any such terms Recipient offers.
jeff@1016 2724
jeff@1016 2725 4. Termination. This License and the rights granted hereunder will terminate
jeff@1016 2726 automatically if Recipient fails to comply with terms herein and fails to cure
jeff@1016 2727 such breach within 30 days of the breach. Any sublicense to the Subject
jeff@1016 2728 Software which is properly granted shall survive any termination of this
jeff@1016 2729 License absent termination by the terms of such sublicense. Provisions which,
jeff@1016 2730 by their nature, must remain in effect beyond the termination of this License
jeff@1016 2731 shall survive.
jeff@1016 2732
jeff@1016 2733 5. No Trademark Rights. This License does not grant any rights to use any
jeff@1016 2734 trade name, trademark or service mark whatsoever. No trade name, trademark or
jeff@1016 2735 service mark of SGI may be used to endorse or promote products derived from
jeff@1016 2736 the Subject Software without prior written permission of SGI.
jeff@1016 2737
jeff@1016 2738 6. No Other Rights. This License does not grant any rights with respect to the
jeff@1016 2739 OpenGL API or to any software or hardware implementation thereof or to any
jeff@1016 2740 other software whatsoever, nor shall any other rights or licenses not
jeff@1016 2741 expressly granted hereunder arise by implication, estoppel or otherwise with
jeff@1016 2742 respect to the Subject Software. Title to and ownership of the Original
jeff@1016 2743 Software at all times remains with SGI. All rights in the Original Software
jeff@1016 2744 not expressly granted under this License are reserved.
jeff@1016 2745
jeff@1016 2746 7. Compliance with Laws; Non-Infringement. Recipient shall comply with all
jeff@1016 2747 applicable laws and regulations in connection with use and distribution of the
jeff@1016 2748 Subject Software, including but not limited to, all export and import control
jeff@1016 2749 laws and regulations of the U.S. government and other countries. Recipient may
jeff@1016 2750 not distribute Subject Software that (i) in any way infringes (directly or
jeff@1016 2751 contributorily) the rights (including patent, copyright, trade secret,
jeff@1016 2752 trademark or other intellectual property rights of any kind) of any other
jeff@1016 2753 person or entity or (ii) breaches any representation or warranty, express,
jeff@1016 2754 implied or statutory, which under any applicable law it might be deemed to
jeff@1016 2755 have been distributed.
jeff@1016 2756
jeff@1016 2757 8. Claims of Infringement. If Recipient at any time has knowledge of any one
jeff@1016 2758 or more third party claims that reproduction, modification, use, distribution,
jeff@1016 2759 import or sale of Subject Software (including particular functionality or code
jeff@1016 2760 incorporated in Subject Software) infringes the third party's intellectual
jeff@1016 2761 property rights, Recipient must place in a well-identified web page bearing
jeff@1016 2762 the title "LEGAL" a description of each such claim and a description of the
jeff@1016 2763 party making each such claim in sufficient detail that a user of the Subject
jeff@1016 2764 Software will know whom to contact regarding the claim. Also, upon gaining
jeff@1016 2765 such knowledge of any such claim, Recipient must conspicuously include the URL
jeff@1016 2766 for such web page in the Exhibit A notice required under Sections 2 and 3,
jeff@1016 2767 above, and in the text of any related documentation, license agreement or
jeff@1016 2768 collateral in which Recipient describes end user's rights relating to the
jeff@1016 2769 Subject Software. If Recipient obtains such knowledge after it makes Subject
jeff@1016 2770 Software available to any other person or entity, Recipient shall take other
jeff@1016 2771 steps (such as notifying appropriate mailing lists or newsgroups) reasonably
jeff@1016 2772 calculated to inform those who received the Subject Software that new
jeff@1016 2773 knowledge has been obtained.
jeff@1016 2774
jeff@1016 2775 9. DISCLAIMER OF WARRANTY. SUBJECT SOFTWARE IS PROVIDED ON AN "AS IS" BASIS,
jeff@1016 2776 WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT
jeff@1016 2777 LIMITATION, WARRANTIES THAT THE SUBJECT SOFTWARE IS FREE OF DEFECTS,
jeff@1016 2778 MERCHANTABLE, FIT FOR A PARTICULAR PURPOSE OR NON- INFRINGING. SGI ASSUMES NO
jeff@1016 2779 RISK AS TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE. SHOULD ANY SOFTWARE
jeff@1016 2780 PROVE DEFECTIVE IN ANY RESPECT, SGI ASSUMES NO COST OR LIABILITY FOR ANY
jeff@1016 2781 SERVICING, REPAIR OR CORRECTION. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN
jeff@1016 2782 ESSENTIAL PART OF THIS LICENSE. NO USE OF ANY SUBJECT SOFTWARE IS AUTHORIZED
jeff@1016 2783 HEREUNDER EXCEPT UNDER THIS DISCLAIMER.
jeff@1016 2784
jeff@1016 2785 10. LIMITATION OF LIABILITY. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY,

jeff@1016 2795 ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO
jeff@1016 2796 THAT EXCLUSION AND LIMITATION MAY NOT APPLY TO RECIPIENT.
jeff@1016 2797
jeff@1016 2798 11. Indemnity. Recipient shall be solely responsible for damages arising,
jeff@1016 2799 directly or indirectly, out of its utilization of rights under this License.
jeff@1016 2800 Recipient will defend, indemnify and hold harmless Silicon Graphics, Inc. from
jeff@1016 2801 and against any loss, liability, damages, costs or expenses (including the
jeff@1016 2802 payment of reasonable attorneys fees) arising out of Recipient's use,
jeff@1016 2803 modification, reproduction and distribution of the Subject Software or out of
jeff@1016 2804 any representation or warranty made by Recipient.
jeff@1016 2805
jeff@1016 2806 12. U.S. Government End Users. The Subject Software is a "commercial item"

jeff@1016 2896 part of a product, or in any medium of storage, with any file that does
jeff@1016 2897 contain Original Software or any previous Modification.
jeff@1016 2898
jeff@1016 2899 2. License Terms. All distribution of the Subject Software must be made
jeff@1016 2900 subject to the terms of this License. A copy of this License and the Required

jeff@1016 2903 Technology are described. Distributions of Subject Software in source code
jeff@1016 2904 form must also include the Required Notice in every file distributed. In
jeff@1016 2905 addition, a ReadMe file entitled "Important Legal Notice" must be distributed

jeff@1016 2913 this License as applicable to the Subject Software, (iii) Recipient hereby
jeff@1016 2914 indemnifies SGI for any liability incurred by SGI as a result of the
jeff@1016 2915 distribution of Accompanying Technology or the use of other license terms.
jeff@1016 2916
jeff@1016 2917 3. Termination. This License and the rights granted hereunder will terminate
jeff@1016 2918 automatically if Recipient fails to comply with terms herein and fails to cure
jeff@1016 2919 such breach within 30 days of the breach. Any sublicense to the Subject
jeff@1016 2920 Software that is properly granted shall survive any termination of this
jeff@1016 2921 License absent termination by the terms of such sublicense. Provisions which,
jeff@1016 2922 by their nature, must remain in effect beyond the termination of this License
jeff@1016 2923 shall survive.

jeff@1016 2929
jeff@1016 2930 5. No Other Rights. No rights or licenses not expressly granted hereunder
jeff@1016 2931 shall arise by implication, estoppel or otherwise. Title to and ownership of

jeff@1016 2949 incorporated in Subject Software) infringes the third party's intellectual
jeff@1016 2950 property rights, Recipient must place in a well-identified web page bearing
jeff@1016 2951 the title "LEGAL" a description of each such claim and a description of the
jeff@1016 2952 party making each such claim in sufficient detail that a user of the Subject
jeff@1016 2953 Software will know whom to contact regarding the claim. Also, upon gaining
jeff@1016 2954 such knowledge of any such claim, Recipient must conspicuously include the URL
jeff@1016 2955 for such web page in the Required Notice, and in the text of any related
jeff@1016 2956 documentation, license agreement or collateral in which Recipient describes

jeff@1016 2958 knowledge after it makes Subject Software available to any other person or
jeff@1016 2959 entity, Recipient shall take other steps (such as notifying appropriate
jeff@1016 2960 mailing lists or newsgroups) reasonably calculated to provide such knowledge
jeff@1016 2961 to those who received the Subject Software.
jeff@1016 2962

duke@1 3212 and conversions to other media types.
duke@1 3213
duke@1 3214 "Work" shall mean the work of authorship, whether in Source or
jeff@1016 3215 Object form, made available under the License, as indicated by a
jeff@1016 3216 copyright notice that is included in or attached to the work
duke@1 3217 (an example is provided in the Appendix below).
duke@1 3218
jeff@1016 3219 "Derivative Works" shall mean any work, whether in Source or Object
jeff@1016 3220 form, that is based on (or derived from) the Work and for which the
jeff@1016 3221 editorial revisions, annotations, elaborations, or other modifications
jeff@1016 3222 represent, as a whole, an original work of authorship. For the purposes
jeff@1016 3223 of this License, Derivative Works shall not include works that remain
jeff@1016 3224 separable from, or merely link (or bind by name) to the interfaces of,
jeff@1016 3225 the Work and Derivative Works thereof.
duke@1 3226
duke@1 3227 "Contribution" shall mean any work of authorship, including
jeff@1016 3228 the original version of the Work and any modifications or additions
jeff@1016 3229 to that Work or Derivative Works thereof, that is intentionally
jeff@1016 3230 submitted to Licensor for inclusion in the Work by the copyright owner
jeff@1016 3231 or by an individual or Legal Entity authorized to submit on behalf of
jeff@1016 3232 the copyright owner. For the purposes of this definition, "submitted"
jeff@1016 3233 means any form of electronic, verbal, or written communication sent
jeff@1016 3234 to the Licensor or its representatives, including but not limited to
jeff@1016 3235 communication on electronic mailing lists, source code control systems,
jeff@1016 3236 and issue tracking systems that are managed by, or on behalf of, the
jeff@1016 3237 Licensor for the purpose of discussing and improving the Work, but
jeff@1016 3238 excluding communication that is conspicuously marked or otherwise
jeff@1016 3239 designated in writing by the copyright owner as "Not a Contribution."
jeff@1016 3240
jeff@1016 3241 "Contributor" shall mean Licensor and any individual or Legal Entity
jeff@1016 3242 on behalf of whom a Contribution has been received by Licensor and
jeff@1016 3243 subsequently incorporated within the Work.
jeff@1016 3244
jeff@1016 3245 2. Grant of Copyright License. Subject to the terms and conditions of
jeff@1016 3246 this License, each Contributor hereby grants to You a perpetual,
jeff@1016 3247 worldwide, non-exclusive, no-charge, royalty-free, irrevocable
duke@1 3248 copyright license to reproduce, prepare Derivative Works of,
jeff@1016 3249 publicly display, publicly perform, sublicense, and distribute the
jeff@1016 3250 Work and such Derivative Works in Source or Object form.
duke@1 3251
duke@1 3252 3. Grant of Patent License. Subject to the terms and conditions of
jeff@1016 3253 this License, each Contributor hereby grants to You a perpetual,
jeff@1016 3254 worldwide, non-exclusive, no-charge, royalty-free, irrevocable
jeff@1016 3255 (except as stated in this section) patent license to make, have made,
jeff@1016 3256 use, offer to sell, sell, import, and otherwise transfer the Work,
jeff@1016 3257 where such license applies only to those patent claims licensable
jeff@1016 3258 by such Contributor that are necessarily infringed by their
jeff@1016 3259 Contribution(s) alone or by combination of their Contribution(s)
jeff@1016 3260 with the Work to which such Contribution(s) was submitted. If You
jeff@1016 3261 institute patent litigation against any entity (including a
jeff@1016 3262 cross-claim or counterclaim in a lawsuit) alleging that the Work
jeff@1016 3263 or a Contribution incorporated within the Work constitutes direct
jeff@1016 3264 or contributory patent infringement, then any patent licenses
duke@1 3265 granted to You under this License for that Work shall terminate
duke@1 3266 as of the date such litigation is filed.
duke@1 3267
duke@1 3268 4. Redistribution. You may reproduce and distribute copies of the
duke@1 3269 Work or Derivative Works thereof in any medium, with or without
duke@1 3270 modifications, and in Source or Object form, provided that You
duke@1 3271 meet the following conditions:
duke@1 3272
duke@1 3273 (a) You must give any other recipients of the Work or
duke@1 3274 Derivative Works a copy of this License; and
duke@1 3275
jeff@1016 3276 (b) You must cause any modified files to carry prominent notices
jeff@1016 3277 stating that You changed the files; and
duke@1 3278
duke@1 3279 (c) You must retain, in the Source form of any Derivative Works
duke@1 3280 that You distribute, all copyright, patent, trademark, and
duke@1 3281 attribution notices from the Source form of the Work,
duke@1 3282 excluding those notices that do not pertain to any part of
duke@1 3283 the Derivative Works; and
duke@1 3284
duke@1 3285 (d) If the Work includes a "NOTICE" text file as part of its
jeff@1016 3286 distribution, then any Derivative Works that You distribute must
jeff@1016 3287 include a readable copy of the attribution notices contained
jeff@1016 3288 within such NOTICE file, excluding those notices that do not
jeff@1016 3289 pertain to any part of the Derivative Works, in at least one
jeff@1016 3290 of the following places: within a NOTICE text file distributed
jeff@1016 3291 as part of the Derivative Works; within the Source form or
jeff@1016 3292 documentation, if provided along with the Derivative Works; or,
jeff@1016 3293 within a display generated by the Derivative Works, if and
jeff@1016 3294 wherever such third-party notices normally appear. The contents
jeff@1016 3295 of the NOTICE file are for informational purposes only and
duke@1 3296 do not modify the License. You may add Your own attribution
jeff@1016 3297 notices within Derivative Works that You distribute, alongside
jeff@1016 3298 or as an addendum to the NOTICE text from the Work, provided
jeff@1016 3299 that such additional attribution notices cannot be construed
jeff@1016 3300 as modifying the License.
jeff@1016 3301
jeff@1016 3302 You may add Your own copyright statement to Your modifications and
jeff@1016 3303 may provide additional or different license terms and conditions
jeff@1016 3304 for use, reproduction, or distribution of Your modifications, or
jeff@1016 3305 for any such Derivative Works as a whole, provided Your use,
jeff@1016 3306 reproduction, and distribution of the Work otherwise complies with
jeff@1016 3307 the conditions stated in this License.
jeff@1016 3308
jeff@1016 3309 5. Submission of Contributions. Unless You explicitly state otherwise,
jeff@1016 3310 any Contribution intentionally submitted for inclusion in the Work
jeff@1016 3311 by You to the Licensor shall be under the terms and conditions of
jeff@1016 3312 this License, without any additional terms or conditions.
jeff@1016 3313 Notwithstanding the above, nothing herein shall supersede or modify
jeff@1016 3314 the terms of any separate license agreement you may have executed
jeff@1016 3315 with Licensor regarding such Contributions.
jeff@1016 3316
jeff@1016 3317 6. Trademarks. This License does not grant permission to use the trade
jeff@1016 3318 names, trademarks, service marks, or product names of the Licensor,
jeff@1016 3319 except as required for reasonable and customary use in describing the
jeff@1016 3320 origin of the Work and reproducing the content of the NOTICE file.
jeff@1016 3321
duke@1 3322 7. Disclaimer of Warranty. Unless required by applicable law or
duke@1 3323 agreed to in writing, Licensor provides the Work (and each
duke@1 3324 Contributor provides its Contributions) on an "AS IS" BASIS,
duke@1 3325 WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, either express or
jeff@1016 3326 implied, including, without limitation, any warranties or conditions
jeff@1016 3327 of TITLE, NON-INFRINGEMENT, MERCHANTABILITY, or FITNESS FOR A
jeff@1016 3328 PARTICULAR PURPOSE. You are solely responsible for determining the
jeff@1016 3329 appropriateness of using or redistributing the Work and assume any
jeff@1016 3330 risks associated with Your exercise of permissions under this License.
jeff@1016 3331
duke@1 3332 8. Limitation of Liability. In no event and under no legal theory,
duke@1 3333 whether in tort (including negligence), contract, or otherwise,
jeff@1016 3334 unless required by applicable law (such as deliberate and grossly
jeff@1016 3335 negligent acts) or agreed to in writing, shall any Contributor be
jeff@1016 3336 liable to You for damages, including any direct, indirect, special,
jeff@1016 3337 incidental, or consequential damages of any character arising as a
jeff@1016 3338 result of this License or out of the use or inability to use the
jeff@1016 3339 Work (including but not limited to damages for loss of goodwill,
jeff@1016 3340 work stoppage, computer failure or malfunction, or any and all
duke@1 3341 other commercial damages or losses), even if such Contributor
duke@1 3342 has been advised of the possibility of such damages.
duke@1 3343
jeff@1016 3344 9. Accepting Warranty or Additional Liability. While redistributing
jeff@1016 3345 the Work or Derivative Works thereof, You may choose to offer,
jeff@1016 3346 and charge a fee for, acceptance of support, warranty, indemnity,
jeff@1016 3347 or other liability obligations and/or rights consistent with this
jeff@1016 3348 License. However, in accepting such obligations, You may act only
jeff@1016 3349 on Your own behalf and on Your sole responsibility, not on behalf
jeff@1016 3350 of any other Contributor, and only if You agree to indemnify,
duke@1 3351 defend, and hold each Contributor harmless for any liability
jeff@1016 3352 incurred by, or claims asserted against, such Contributor by reason
jeff@1016 3353 of your accepting any such warranty or additional liability.

jeff@1016 3365 same "printed page" as the copyright notice for easier
duke@1 3366 identification within third-party archives.
